The Texas Prompt Payment Act was created to help doctors, physician groups, hospitals and clinics recover overdue, underpaid, or unpaid insurance payments.  The law states that if a healthcare provider does not receive his or her fees on time and in full, the insurance company can be subjected to steep penalties.

Prompt Pay Law

Insurance companies can be a burden to your practice.  Fortunately, the law is favorable to doctors seeking to recover payment and it imposes strict penalties for insurers that do not pay fees on time and in full. When a payment is late, the insurance provider is subjected to the following graduated penalties in addition to the fees already owed:

  • Overdue by 1 to 45 days: 50% of the difference between the contracted rate and billed charges, or $100,000, whichever is less
  • Overdue by 46 to 90 days: 100% of the difference between the contracted rate and billed charges, or $200,000, whichever is less
  • Overdue by 91 or more days: 100% of the difference between the contracted rate and billed charges plus an additional 18% annual interest on the penalty amount
